Guidelines for Acquiring Real Estate in Dubai

The process of acquiring property in Dubai is designed to be straightforward, whether you’re purchasing from an existing homeowner or directly from developers. Once you’ve identified your ideal property, we are committed to assisting you through the subsequent steps to successfully finalize the purchase

This document will outline the mutually agreed-upon terms and conditions between the seller and the buyer. It will specify crucial details such as the selling price, payment method, and any other pertinent factors that legally bind the contract.

The buyer and seller, serving as witnesses to the transaction, will jointly sign a Memorandum of Understanding (MOU) or Form F. As a standard practice, the buyer is required to submit a 10% security deposit to the escrow account, typically managed by the real estate broker. This deposit is refundable upon the completion of the property transfer. In cases involving a bank, the buyer needs to provide a valuation report and the final offer letter confirming the mortgage arrangement. If the property is currently mortgaged, the buyer is obligated to settle the seller’s mortgage before initiating the application for a No Objection Certificate (NOC).

For the transfer of ownership, obtaining a No Objection Certificate (NOC) from the developer is imperative. The developer will only issue the NOC upon verification that there are no outstanding service charges or late payment fees/penalties associated with the property.

After securing the No Objection Certificate (NOC) from the property developer, the buyer and seller will convene at the Dubai Land Department office to formalize the transfer. The following prerequisites are essential for the transfer to be completed:

  • 1.  A manager’s cheque, covering the property price, made payable to the seller.
  1. 2.  Original identification documents of both the buyer and seller (Emirates ID, passport, and visa).
  2. 3.  The original NOC issued by the developer.
  3. 4.  Signed Memorandum of Understanding (MOU).

Upon successfully navigating these steps, a new title deed will be issued in the buyer’s name, marking the official transfer of ownership.
